1. General provisions

1. Under Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “GDPR”), DAG agency s.r.o., ID No.: 05681014, with its registered office at Lounín 49, 267 01 Tmaň, Czech Republic, is the personal data Controller (hereinafter referred to as the “Controller”).

3. Personal data means any and all information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to a certain identifier, for example, a name, an identification number, location data, an online identifier or by reference to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

4. The Controller has not appointed a data protection officer.

2. Sources and categories of personal data processed

1. The Controller processes personal data that you have provided or personal data that the Controller has obtained as a result of fulfilling your order.

2. The Controller processes your identification, contact and data necessary for performing the contract.

3. Legal grounds and purpose of personal data processing

1. Legal grounds for personal data processing are represented by

  • Performing the contract between you and the Controller pursuant to Article 6 (1) (b) of the GDPR,
  • The legitimate interest of the Controller in providing direct marketing (in particular for sending business-related communications and newsletters) pursuant to Article 6(1)(b) of the GDPR,
  • Your consent to the processing for the purpose of providing direct marketing (in particular, for sending business-related communications and newsletters) pursuant to Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act number 480/2004 Sb., on Certain Services of Information Society, in case no order for goods or service has been placed.

2. The purpose of personal data processing is represented by

  • Processing your order and exercising rights and obligations arising from the contractual relationship between you and the Controller; when placing an order, personal data are required that are required to successfully process your order (name and address, contact); providing personal data is a requirement for entering into and performing the contract; it is not possible to enter into any contract, neither is it possible to perform any contract by the Controller without providing personal data,
  • Sending business-related communications and performing other marketing activities.

3. There is no automated individual decision-making by the Controller within the meaning of Article 22 of the GDPR.

4. Data retention period

1. The Controller retains personal data

  • For a period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and to assert claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
  • For such a period until your consent to personal data processing for marketing purposes is withdrawn, but no longer than 5 years if the personal data are processed based on your consent.

2. The Controller shall delete personal data after the period for personal data retention expires.

5. Recipients of personal data (subcontractors of the Controller)

1. The recipients of the personal data are, Persons involved in delivering goods/services/making payments under a contract/suppliers of the

  • Persons involved in providing website operation services,
  • Persons involved in providing marketing services

2. The Controller does not intend to transfer personal data to a third country (to a country outside the EU) or an international organisation.

6. Your rights

1. Under the conditions set out in the GDPR, you have the following rights

  • The right to access your personal data pursuant to Article 15 of the GDPR,
  • The right to have your personal data corrected pursuant to Article 16 of the GDPR or the right to restrict processing according to Article 18 GDPR,
  • The right to have your personal data erased pursuant to Article 17 of the GDPR, The right to object to the processing pursuant to Article 21 of the GDPR
  • The right to data portability pursuant to Article 20 of the GDPR,
  • The right to withdraw your consent to processing in writing or electronically to the address or e-mail info@dagagency.cz specified in Article 3 of these terms and conditions.

2. Furthermore, you have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to the protection of personal data has been violated.

7. Terms and conditions of personal data security

1. The Controller declares that he has taken all appropriate technical and organisational measures to secure personal data.

2. The Controller declares that only persons authorised by the Controller can access personal data.

8. Final Provisions

1. By sending an order on the online order form, you confirm that you are familiar with the terms and conditions of personal data protection and that you accept them in their entirety.

2. You agree to these terms and conditions by ticking your consent through the online form. By checking your consent, you confirm that you are familiar with the terms and conditions of personal data protection and that you accept them in their entirety.

3. The Controller is entitled to change these terms and conditions. The Controller shall publish the revised terms and conditions of personal data protection on its website and, at the same time, send you the revised terms and conditions to the e-mail you have provided the Controller with.
